Harbor Telco Security LICENSE AND LIMITED WARRANTY
This legal document is an agreement between you ("Licensee") and Harbor Telco Security ("Harbor Telco Security").
In consideration of your payment of the license fee and your agreement to abide by the terms of this agreement, Harbor Telco Security agrees to grant, AND you agree to accept on the following terms and conditions, a personal non-transferable and non-exclusive limited license to use the Licensed software and online help manual. You assume the responsibility for the selection of the program to achieve your intended results, and for the installation, use and results obtained.
LICENSE AUTHORIZATION
This license authorizes you to:
a. use the Software on a SINGLE machine; and
b. make one (1) copy of the Software for backup purposes only in support of your use of the program on the single machine.
OWNERSHIP OF SOFTWARE
Title to the Software will at all times remain with Harbor Telco Security. You may not modify, adapt, translate, reverse engineer, decompile or disassemble the Software.
COPY RESTRICTIONS
This software and the accompanying written materials are copyrights. Unauthorized copying of the Software or written materials is expressly forbidden. You may be held legally responsible for any copyright infringement which is caused or encouraged by your failure to abide by the terms of this agreement.
USE RESTRICTIONS
As the licensee, you may physically transfer the Software from one computer to another provided that the Software is used on only one computer at a time. You may not electronically transfer the Software from one computer to another over a network. You may not adopt, translate, or create derivative works based on the written materials without prior written consent of Harbor Telco Security.
TRANSFER RESTRICTIONS
This Software is licensed only to you and may not be transferred to anyone without the prior written consent of Harbor Telco Security.
TERM OF LICENSE
This License is effective until terminated. This license will terminate immediately without notice from Harbor Telco Security if you fail to comply with any provision of this license. Upon termination, you must destroy the Software, the written materials, and all copies. You may terminate the license at any time by destroying the Software, the written materials, and all copies.
UPDATE POLICY
Harbor Telco Security may create, from time to time, updated versions of the Software. At its option, Harbor Telco Security will make such updates available to Licensees who have completed and returned the Registration Card to Harbor Telco Security and paid the update fee, if any.
LIMITED WARRANTY
Harbor Telco Security warrants that the Software will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt. Harbor Telco Security does not warrant, guarantee or make any representation regarding the use, of the Software or written materials in terms of correctness, accuracy, reliability, currency, or otherwise. The entire risk, as to the results and performance of the Software, is assumed by you.
Harbor Telco Security 's entire liability and your exclusive remedy shall be the replacement of any diskette(s) found to be defective and returned by you, the Original Registered licensee, within ninety (90) days from the date of purchase prepaid with a copy of the receipt of purchase.
The above is the only warranty of any kind, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability and fitness for a particular purpose that is made by Harbor Telco Security on the Software. No oral or written information or advice given by Harbor Telco Security, its dealers, distributors, agents, or employees shall create a warranty or in any way increase the scope of this warranty and you may not rely on any such information or advice.
Neither Harbor Telco Security nor anyone else who has been involved in the creation, production, or delivery of the product shall be liable for any direct, indirect, consequential, or incidental damages (including damages for loss of business profits, business interruption, loss of business information, loss of health or any loss whatsoever) arising out of the use or inability to use such product, even if Harbor Telco Security has been advised of the possibility of such damages.
This warranty gives you specific rights. You may have other rights which vary by state, and certain limitations contained in the limited warranty may not apply to you.
This agreement shall be governed by the laws of the state of New Hampshire.
